Terms of Service - Jump to Design Agreement

We have the responsibility to protect each client and provide them with the best services available. The following guidelines were designed to insure these services.

Account Activation:

All accounts are setup within 24 hours of receiving the initial order. You will receive a welcome email giving you your login name and password and your account will then be active and available for use. If you were also registered for a new domain name, as soon as the DNS (Domain Name Servers) are propagated by the network which usually takes 24-72 hours, you will be able to upload your site.

Payment:

Unless otherwise specified, all fees and related charges shall be due and payable within ten (10) days after the date of the invoice. Your invoice date is determined by your account activation date. If any invoice is not paid within 10 days after the invoice date, the account will be suspended. Suspended accounts for hosting can be reinstated by submitting the required payment.

In the event that any amount due to Web Jett & Assoc. remains unpaid thirty (30) days after such payment is due the unpaid services will be terminated. Any and all agreements will be terminated as well.

Customer acknowledges and agrees that Web Jet may charge Customer's fees for the Services to its credit card supplied by Customer during registration for the Initial Term.

YOU ACKNOWLEDGE, AGREE AND AUTHORIZE WEB JETT & ASSOC. TO AUTOMATICALLY BILL AND/OR CHARGE ON YOUR CREDIT CARD FOR SUCCESSIVE TERMS OF EQUAL LENGTH AS THE INITIAL TERM, UNLESS TERMINATED OR CANCELLED BEFORE PAYMENT IS DUE AND UNLESS OTHER ARRANGEMENTS ARE MADE.

Money Back Guarantee:

You should be satisfied with your web host. If for any reason you are not satisfied within your first 7 days of hosting. Cancel for a complete refund. Set-up, domain registration & design fees are non-refundable.

Domain Names:

We work with accredited I.C.A.N.N suppliers to sell domain names. Once purchased, Domain Name fees are non-refundable. Fees are paid annually for the domain name. If you do not pay for the annual renewal by the due date the following year, your domain name could go inactive and/or be purchased by someone else. If you have paid for us to maintain your interest in the domain we will notify you on an annual basis for renewal. See our Domain Registration page.

I understand that my name and address will be listed as the "registrant" of my domain name and that this is public information unless I choose to purchase "privacy protection". I understand that "Web Jett & Assoc." will be listed as the "Administrative, Technical & Billing" contacts for my domain name. I understand that as the owner of said domain name I am responsible for any and all requirements of that domain as listed by "ICANN" - "The Internet Corporation for Assigned Names and Numbers" .

Restricted Content:

Web Jett hosting accounts may be used for most legal commercial and non-commercial purposes. Web Jett does however specifically prohibit the use of our servers for the following:

* IRC bots or servers
* the dissemination of SPAM
* Inflammatory or Hate sites
* adult or sexual content which is illegal in the United States of America
* providing tools for or acting as a launching point for attacks on network services internal and external
* hosting illegal content including but not limited to illegal software (WAREZ), illegal MP3s and other media, etc

Web Jett & Assoc. will be the sole arbiter as to what constitutes a violation of this provision & will be the sole arbiter as to what constitutes a violation of this provision.

SPAM:
The use of Web Jett's servers for unsolicited mass mailings or inappropriate Usenet postings by any customer is strictly forbidden. Violations of this policy will result in immediate account termination without warning, and the customer will be held legally responsible for the damages to Web Jett or it's service providers both monetary and in reputation. The use of any other service to make such a mailing or posting, with any reference to Web Jett or it's service providers services (including but not limited to mailboxes, auto responders, and Web pages), shall also be grounds for account termination as described above. Malicious or threatening email is also prohibited. We reserve the right to immediately deactivate your use of our service if we discover such activity. Further, you agree to indemnify and hold us harmless from any claim resulting from your use or distribution of electronic mail services through the service provided through this Agreement. Anyone using our services for spamming will be immediately subject to a $250 cleanup/network abuse fee.

Interactive 'chat' applications:
"Chat" applications may not be hosted on Web Jett's servers. For the purposes of this policy, a "chat" system is defined as a Web site or portion thereof that encourages visitors to post messages that are immediately viewable by other users, in order to engage in "real-time" conversation with other visitors at the same site. Java based "chat" clients which connect with chat servers not hosted by Web Jett are however permissible since they do not impact Web Jett web server loading.

This policy has been instituted due to the rather severe impact "chat" scripts impose on a web server. An impact that if not restricted would adversely affect other accounts co-resident on the server. If you have specific needs to host a "chat" application, you are encouraged to contact our sales department to discuss alternative hosting options we may be able to offer.

Adult oriented sites:
Adult-oriented sites, designed for entertainment or commercial purposes, are not allowed on Web Jett's servers. Forbidden sites include those that provide access to pornographic materials, whether for free or for payment, regardless of whether adult verification is used or not.

This policy has been instituted due to the disproportionately high traffic volume an adult oriented site generates. Such traffic patterns could unfairly bog down the web server to the detriment of other clients co-resident on the server. If you have a special need to host such a high traffic web site, contact our skilled sales staff, who in conjunction with our support staff, can hook you up with an affordable alternate hosting solution through another adult hosting service.

Server-side processes:
The installation or operation of any stand-alone, unattended server-side process (daemons) on Web Jett servers, is forbidden, except by special arrangement. This specifically includes IRC bots, clients, and other IRC-related processes. Use of such a process to accept network connections, for any purpose whatsoever, is expressly forbidden. Violation of this policy will result in immediate account termination without warning.

Resource usage:
CGI scripts and programs are subject to resource limitations as set forth by this policy.

CPU Time Used - 30 seconds
Number of Open Files - 32
Number of Simultaneous Processes - 8
Cron job interval - No one scheduled job should run more often than once every 2 hours
Repeated usage of a disproportionately large percentage of CPU time by any hosted site is forbidden. Violators will be warned of such violations and shall be required to remedy the situation within 48 hours of notification. Repeat offenders shall face the potential of account suspension without warning.

Unacceptable content:
The following content may not be hosted on Web Jett's servers. This includes web pages including links and/or references to the following prohibited content:

Pirated software (illegal duplication, distribution of licensed software)
Illegally distributed electronic music, including, but not limited to, illegally distributed MP3 files.
Hacking tools, programs, or archives
'Warez' sites (sites featuring 'cracks' to licensed software)
Adult oriented sites (see separate policy pertaining to this)
Violators of this policy may be subject to account termination as determined by the severity of the offense. Web Jett shall be the sole arbiter as to what constitutes a violation of this policy and what action should be taken.

Activities Subject to Immediate Deactivation:

Any Hosting Account that is used for Illegal, Abusive or Unethical Activity may be immediately deactivated by us without warning to you. Any misuse or overuse of the server will result in immediate deactivation of an account. Illegal, Abusive or Unethical Activities include, but are not limited to inclusion of or linking to, pornography, obscenity, nudity, violations of privacy, hacking, irc related scripts and programs, non approved server scripts, eggdrops, computer virus, and any harassing or harmful materials or uses, as determined by us. You agree to indemnify and hold us harmless from any claim resulting from your publications or use of Illegal, Abusive or Unethical materials. Although we will make reasonable efforts to alert you to such activities and allow you an opportunity to cure them within a 12-hour period after discovery, we are not required to give notice before deactivating your use of our services if, in our discretion, your use is or results in Illegal, Abusive or Unethical activities. If a Hosting Account is disabled, the regular monthly fees still apply. Web Jett & Assoc. reserves the right to Cancel/Deactivate any account at any time for any reason.

Examples include, but are not limited to:

Mailing Lists:
We have a strict policy regarding use/spam on our network, but we do allow use of mailing lists within the constraints of our spam policy above. However, sending thousands of e-mails off of a given server can impact the performance of the server. Therefore we limit the amount of e-mail allowed on our Shared Servers to no more than 1000 e-mails per day and 30 emails in 10 seconds .

The standard mailing list features provided in conjunction with a Web Jett hosting account shall be used for low volume mailing lists only. Low volume is defined as lists with no more than 50 subscribers and no more than 50 posts to the list per day. Usage levels beyond this are discouraged unless prior arrangements have been made with Web Jett. Accommodation of higher volume lists may be limited and may come at additional cost. Web Jet's mailing list usage policy is aimed at protecting the server from excessive loading due to high mailing list volume. These measures are necessary to ensure the quality of web hosting services on any server are not compromised.

Liability:

Web Jett & Assoc. is in no way responsible for down time either resulting from a users actions, or natural fluctuations in internet consistency. Web Jett & Assoc. will however, do everything within it's power to assure that each and every client site is up as consistently as possible. Web Jett & Assoc. is in no way responsible for the data on your site. We do keep ackups of every site we host but we do not guarantee the usability of our backups. You should always keep a backup of all data.

Refunds:

We have a 7 day unconditional money back guarantee on hosting accounts. To cancel your account and receive a refund please go to the Support Forum to send an email requesting cancellation with a contact phone number. To protect our customers and to ensure your identity, all requests for refunds will be verified by phone. All cancellations must be received within 7 days of account activation to receive a refund. Refunds will not be given after the 7 day period has passed. After cancellation notice is received, refunds will be processed within 7 additional days. Refunds are not given on domain name registrations for any reason. Design fees, dedicated servers and setup fees (ie. stacking domains, dedicated, etc.) are non-refundable.

Account Closure:

If you choose to close your hosting account, please go to the Support Forum to send an email requesting cancellation (must have a contact phone number) 7 days prior to your billing cycle date and we will cancel your account at your request. Prepaid hosting is non-refundable but your site will stay live until the end of your billing period unless you request otherwise.

Misc Charge backs/Arbitration/Attorney's Fees/Returned Checks:

There is a $50 fee for any illegitimate charge backs placed against us. Any illegitimate charge backs or threatened llegitimate charge backs are grounds for immediate account cancellation.

If Web Jett & Assoc. collects any payment due at law or through an attorney at law or under advice there from or through a collection agency, or if Web Jett & Assoc. prevails in any action to which the Customer and Web Jett & Assoc. are parties, Customer will pay all costs of collection, arbitration and litigation, including, without limitation, all court costs and Web Jett & Assoc. reasonable attorneys' fees.

If any check is returned for insufficient funds Web Jett & Assoc. may impose a processing charge of $25.00.

Design Agreement:

I understand that with the fee I pay for my site to be designed, I agree to the following that:

1.) I am responsible for providing all "site content" for the site regarding my business or web site except for design elements such as clip art and other files normally used for design purposes. This includes any and all photos, verbiage, policies, terms of service, etc. representing your business.
2.) All "site content" should be provided to Web Jett & Assoc.via digital media; EMail, CD-R, ZIP File, Floppy Disc or other suitable media. We do not accept unlimited "photo content" via email. Large scale scanning of any photos are documents is an optional service and not included with flat-rate design fees unless otherwise agreed to.
3 .) I am responsible for the correct content published on the site and it is my responsibility to verify such content once published.
4 .) Web Jett & Assoc. is not responsible for advising you of the legal status of your domain name, business name, trademarks, copyrights, licensing, taxes or any and all items regarding the site name or legality of business ownership.
5.) Web Jett & Assoc.is not responsible for the promotion of your web site or business, unless otherwise contracted to do so. For a small fee we will submit your site to the major search engines.
6.) If you purchase a domain name through us, that domain name must have a hosting account in order for the web address to be available on the internet. We provide several levels of hosting that should suit your small, medium or large business. Hosting accounts not paid by the billing date will be suspended until payment is made.
7.) Web Jett & Assoc. does not guarantee that your site will receive, "hits", "customers", or "sales" for any given product or service. We act only as the publisher/designer of the content provided for your site. You are responsible for the marketing and/or promotion of any product or service offered on your site.
8.) While we want you to be pleased with our design services, our "flat fee" rates for Design do not include unlimited changes. Once the design is complete and we notify you of such completion, you are entitled to request changes of the design for a more suitable look and feel. While this is a 'gray area' in terms of how much time will actually be spent reworking your site, obviously the changes in question must be reasonable and practical. Major changes to the functionality of your site such as but not limited to; adding shopping carts, secure servers, new product lines or numerous additional pages of content will be charged additional design fees.
9.) Once we are in agreement that your site is complete, additional changes of any kind will require a Maintenance agreement. The fees listed on the Maintenance Page are a general guideline for infrequent, frequent & numerous changes. We will work within anyone to arrange for additional maintenance and at a reasonable fee as negotiated for your particular needs.
10 .) Design fees are non-refundable.
